Terms & Conditions of Sale

By accessing our website, placing an order with us or using our services, you agree to be 
bound by these Terms & Conditions of Sale (“Terms”). If you do not agree, you must not use the website or place an order.

These Terms are issued by AOA Family Holding Pty Ltd ATF AOA Family Trust trading 
as DLA Lighting (“DLA Lighting”, “we”, “our”, “us”). References to “you” or “your” mean the customer or user of the website.

These Terms apply in addition to, and should be read together with, our Shipping & 
Delivery Policy, Warranty & Returns Policy and Privacy Policy. If there is any 
inconsistency, these Terms prevail unless we state otherwise.

All sales and interactions with us are governed by the laws of New South Wales, Australia, and any disputes are subject to the exclusive jurisdiction of NSW courts and tribunals.

1) Orders & Order Acceptance

An order is considered received when it is submitted through our website. An order is not 
accepted by us until we confirm acceptance in writing (for example, via order confirmation 
email). We may decline or cancel an order at any time before dispatch if there is a genuine 
reason to do so (including stock unavailability, payment failure, suspected fraud, system or pricing error).

2) Cancellations

Standard (Non-Custom) Products

You may request to cancel an order any time before dispatch. If the order has not yet been dispatched, we will provide a full refund to the original payment method. Once an order has been dispatched, it can no longer be cancelled and will be handled under the Change of-Mind Returns terms in our Warranty & Returns Policy.

Custom or Modified Products

Orders for products that are cut, configured, modified or prepared to order (including 
cut-to-length LED strip and cut aluminium profiles) cannot be cancelled once 
preparation work has commenced.

If a cancellation request is received before work begins, acceptance is at our discretion. If 
accepted, deductions or conditions may apply.

3) Pricing, Availability & Errors

All prices are in Australian dollars (AUD) and include GST unless stated otherwise. We take 
care to ensure accuracy, but pricing, listing, availability and system errors can occur. We 
reserve the right to cancel or amend an order if such an error has occurred — even after an order has been submitted or confirmed. If this happens, we will notify you and offer a refund or the option to proceed at the correct price.

4) Payment Terms

Payment methods available will appear at checkout. By submitting payment, you confirm you are authorised to use the selected method and that details provided are accurate. Orders may be subject to fraud screening or verification checks; we may decline or cancel an order where verification cannot be completed to our reasonable satisfaction.

5) Shipping, Delivery & Risk 

Shipping, dispatch times, freight charges, oversize handling, international conditions and 
related terms are set out in our Shipping & Delivery Policy, which forms part of these 
Terms.

Title (ownership) in goods passes to you once we receive full payment. 
Risk (including loss or damage in transit) passes to you upon delivery to the address you 
provide. If you request Authority To Leave (ATL), delivery is deemed complete once the 
parcel is left at the premises. If ATL is requested, you accept full responsibility for loss, theft or damage after delivery and no replacement, credit or refund will be issued for ATL 
deliveries.

6) Installation & Trades Disclaimer

Electrical products must be installed in accordance with applicable laws and by a licensed 
electrician where required. Do not schedule installation until your order has arrived and 
been inspected. We are not liable for costs associated with missed or rescheduled 
installation appointments.

7) Returns & Warranty

Returns, change-of-mind conditions, exclusions and warranty claim procedures are 
governed by our Warranty & Returns Policy. By purchasing from us, you agree to the rules and limitations set out in that policy.

8) Third-Party Media & Intellectual Property (Inbound Use)

Our website may include images, diagrams, specification sheets or other media sourced 
from manufacturers, suppliers, licensors or publicly available material. We do not claim 
ownership over any third-party media displayed on the website. All such material is provided for reference and illustration only and may differ from the actual product supplied. The presence of third-party media does not create any right, licence or representation beyond what is expressly stated in our product descriptions. If you are the rights holder of any media displayed and believe it has been used without appropriate authorisation, please contact us and we will review and remove the material where appropriate. Visuals do not form part of the contract of sale and cannot be relied upon as a basis for claims, suitability or expectation.

9) Website IP (Outbound Use)

All content on this website — including text, images, documents, designs and names — that is owned by or licensed to DLA Lighting is protected by intellectual property law. You must not copy, reproduce, distribute or modify our owned content without prior written permission.

10) Limitation of Liability & Australian Consumer Law

To the maximum extent permitted by law:

     ●   We are not liable for indirect, incidental, consequential or special loss, including loss 
           of profit, loss of business opportunity or installation-related losses. 
     ●   Our total liability for any claim arising out of a purchase is limited to the amount you paid for the goods in question or replacement of those goods.

Nothing in these Terms limits rights that cannot be excluded under the Australian 
Consumer Law.

11) Entire Agreement

These Terms constitute the entire agreement between you and us in relation to the 
purchase of goods. Any prior representations, advice, quotations or information — whether written, verbal or implied — do not override these Terms unless expressly confirmed by us in writing.

12) Variations & Force Majeure

We may update or amend these Terms at any time by publishing a revised version on our 
website. The version in force at the time you place an order applies to that order. We are not responsible for delays or failures caused by events beyond our reasonable control (including natural disasters, strikes, carrier failures, epidemics, regulatory actions or network outages).
